Pharma marketing is defined by review. Every claim passes medical, legal and regulatory sign-off, and the agency’s job is to produce work that survives it and still performs.
FDA oversight is tightening. OPDP reviews prescription drug promotion to ensure it is truthful, balanced and accurately communicated, and issues untitled and warning letters. On September 9, 2025, FDA announced it was sending thousands of letters asking companies to remove misleading ads and about 100 cease-and-desist letters, citing undisclosed paid influencer promotion and social posts that highlight benefits without harms. FDA also said it was starting rulemaking to close the “adequate provision” approach used in broadcast ads since 1997. Ask how agencies are adapting broadcast, social and creator work, and check the rule’s status with regulatory counsel.
Platform rules add certification steps. Google requires pharmaceutical manufacturers to be certified and restricts prescription drug terms. Since July 1, 2025, advertisers promoting prescription drugs to healthcare professionals with Google’s personalized targeting in the US, Canada and New Zealand need the Restricted Drug Term Personalization Certification, and customer match and lookalike audiences remain off limits. Meta allows prescription drug ads only in the US, Canada and New Zealand, for people 18 and older, from manufacturers that are LegitScript certified or approved through Meta’s internal review.
For OTC drugs and supplements, the FTC has primary responsibility for advertising claims and FDA for labeling, and the FTC expects health claims to rest on competent and reliable scientific evidence.
Pharma work is usually scoped by brand and lifecycle stage under master agreements, with statements of work per campaign and separate media budgets. Timelines must allow for MLR review cycles, which shape everything from social content to website updates.
Ask about the agency’s adverse event monitoring process, how it tracks claim references, how it handles influencer contracts and disclosures, and how it reports results without collecting patient health data improperly.
Prescription drug promotion has to present risks alongside benefits so the overall impression is truthful and balanced, rather than burying safety information. FDA’s OPDP reviews promotional materials and can issue untitled or warning letters. In September 2025 FDA said many social posts highlight benefits but omit harms, making this a current enforcement focus.

Since July 1, 2025, advertisers using Google’s personalized targeting to promote prescription drugs to healthcare professionals in the US, Canada and New Zealand need the Restricted Drug Term Personalization Certification. Advertiser-curated audiences such as customer match and lookalikes cannot be used; predefined Google audiences can.
